Nessie Community Membership Terms & Conditions

Effective date: 1 September 2026

These Terms & Conditions apply to membership of Nessie Community, operated by Nessie in Ed CIC (“Nessie”). By joining Nessie Community, you agree to these Terms & Conditions.

1. About Nessie Community

Nessie Community provides trusted information, practical resources, learning opportunities and support for parents, carers and professionals supporting children and young people.

Membership benefits vary according to the membership level selected.

Nessie Community is intended to provide information, education and support. It is not a substitute for individual medical, therapeutic, legal or other professional advice.

2. Membership Levels

Nessie Trainer – £25 per month / £265 annually

Includes Advanced Member benefits plus additional training, group supervision and opportunities to become approved to deliver specified Nessie training within the community or online. Approved Trainers may also be eligible for paid Nessie delivery opportunities. Trainer status is subject to Nessie’s approval and relevant training and quality requirements.

Nessie Lead Trainer – £30 per month / £315 annually

For experienced Nessie Trainers progressing to a higher level of training and responsibility. Lead Trainers may access additional learning and opportunities to mentor Trainers, represent Nessie, contribute to programme development and undertake approved paid delivery opportunities. Lead Trainer status is subject to Nessie’s approval.

3. One-Off Joining Fee

A one-off £15 joining fee is payable when an individual first becomes a paid Nessie Community member.

Members paying monthly pay the joining fee on joining. It covers their first month of membership, and eleven monthly subscription payments follow.

Members paying annually do not pay the joining fee separately: it is already included within the annual membership price shown.

The joining fee is paid once only. If a member subsequently progresses or moves to another paid membership level, they will not be charged another joining fee.

There is no joining fee for the free EBSA Member level.

4. 12-Month Membership

All paid Nessie Community memberships are a 12-month commitment.

Members may choose to spread the cost of their membership across the year, or pay the full 12-month membership fee upfront.

Choosing monthly payments is a way of spreading the cost of the annual membership. It does not create a month-to-month rolling membership.

Members choosing monthly payments are committing to the £15 joining fee, which covers their first month, together with the eleven monthly subscription payments that follow — subject to their statutory rights and the provisions contained within these Terms.

Paying annually costs less than paying across the year: the annual price is the equivalent of one month's membership lower, and already includes the joining fee.

5. Payment

Membership fees are payable at the rate displayed at the time of joining.

All prices shown are inclusive of VAT. The price displayed is the total amount the member pays.

Members choosing monthly payment must maintain a valid payment method throughout their membership term.

Members choosing annual payment will pay the full 12-month membership fee at the beginning of their membership year.

Where a member pays monthly, the £15 joining fee is payable in addition to the monthly subscription when they first enter paid membership. Where a member pays annually, the joining fee is included within the annual price and is not charged separately.

If a payment fails, Nessie may contact the member and attempt to collect the outstanding amount. Nessie may temporarily suspend membership access where payments remain outstanding.

Suspension for non-payment does not automatically cancel the member’s 12-month payment commitment.

6. Upgrading Your Membership

Members may progress to a higher membership level during their 12-month membership term, subject to any eligibility or approval requirements for that level.

When a member upgrades:

  • their original membership anniversary and renewal date remains the same
  • they will not pay another £15 joining fee
  • the upgrade will not begin a new 12-month membership term
  • their existing membership will be replaced by their new membership level rather than creating two memberships
  • the new membership rate will apply for the remainder of their existing membership year

Members paying monthly: where a member paying monthly upgrades, their future monthly payments will change to the rate applicable to their new membership level from the agreed upgrade date.

Members who have paid annually: where a member has paid their annual membership fee upfront and upgrades during their membership year, Nessie may charge a pro-rata amount representing the difference between the membership levels for the remaining period of their membership year. The original membership renewal date will remain unchanged.

7. Moving to a Lower Membership Level

Members wishing to move to a lower paid membership level may request to do so at the end of their current 12-month membership term.

Moving to a lower membership level will not ordinarily reduce the fees due during an existing 12-month commitment.

Access to benefits associated with the higher membership level will end when the change takes effect.

8. Cancelling Membership

Paid Nessie Community membership is a 12-month commitment.

Members paying monthly cannot ordinarily cancel their membership part-way through their membership year simply by cancelling their payment instruction.

Members remain responsible for payments due for their agreed 12-month membership term.

Where an annual membership has been paid upfront, membership fees will not ordinarily be refunded if a member chooses to leave during their membership year.

Members may give notice that they do not wish to continue their membership beyond the end of their current 12-month term.

Nessie may consider requests to end membership early in exceptional circumstances on a case-by-case basis.

Nothing in these Terms affects a member’s statutory rights.

9. Cooling-Off Period and Consumer Rights

Where membership is purchased online, consumers may have a statutory right to cancel their membership contract within 14 days of entering into it.

Where a member asks for membership services or digital content to be made available during this period, their cancellation and refund rights may be affected in accordance with applicable consumer law.

Where legally required, Nessie will obtain the appropriate consent or acknowledgement before providing immediate access to digital content.

Nothing within these Terms is intended to restrict or remove any statutory rights a member may have.

10. Membership Content and Resources

Membership provides access to the resources, learning and other benefits associated with the member’s current membership level.

Nessie may add, update, replace or withdraw individual resources, sessions or learning materials where reasonably necessary to maintain the quality, relevance and accuracy of Nessie Community.

Where a membership includes learning leading to CPD certification, certification is subject to successful completion of the relevant programme and any applicable completion, participation or assessment requirements.

Membership does not guarantee the successful completion or award of a certificate.

11. Nessie Cuppa Drop-Ins and Live Sessions

Where included within a membership level, members may access Nessie Cuppa drop-ins and other live sessions offered by Nessie.

Dates, times, topics, guests and availability may vary.

Live sessions are intended to provide information, connection and general support and should not be considered individual therapy or clinical advice.

Members must respect the privacy and confidentiality of other participants. Information shared by another member during a session must not be recorded, reproduced or shared outside the session without appropriate permission.

12. Trainer Membership

Trainer Membership provides access to additional training, development, group supervision and opportunities associated with becoming an approved Nessie Trainer.

Payment for Trainer Membership does not automatically authorise an individual to deliver training on behalf of Nessie.

Approval may be subject to:

  • successful completion of required training
  • safeguarding requirements
  • adherence to Nessie’s Code of Conduct
  • appropriate delivery standards
  • use of approved Nessie materials
  • any other reasonable quality requirements specified by Nessie

Approved Trainers may be able to deliver specified Nessie training within their community or online.

Trainer Membership does not guarantee paid work, a minimum number of delivery opportunities or any particular level of income.

13. Trainer Community Contribution

To maintain Trainer status, Trainers are expected to support a minimum of three community-based EBSA awareness sessions during each membership year.

These sessions form part of Nessie’s aim to increase access to information and support within local communities.

Further guidance on community delivery will be provided to Trainers.

14. Paid Trainer Opportunities

From time to time, Nessie may make paid delivery opportunities available to approved Trainers and Lead Trainers.

Availability will depend on demand, location, suitability and other programme requirements.

Membership does not guarantee paid work.

Where a paid opportunity is offered, the applicable payment arrangements and delivery requirements will be communicated separately.

15. Lead Trainer Membership

Lead Trainer Membership is a progression pathway for experienced Nessie Trainers and is subject to Nessie’s approval.

Progression may take into account:

  • completion of required training
  • experience
  • quality of delivery
  • safeguarding requirements
  • conduct
  • participation within Nessie Community
  • the needs of the programme

Lead Trainers may have opportunities to:

  • undertake additional Nessie training
  • mentor and support Trainers
  • facilitate supervision where appropriately trained and approved
  • represent Nessie at approved events
  • contribute to training quality and course development
  • contribute to the development of Nessie Community
  • access additional paid delivery opportunities

Lead Trainer Membership does not guarantee paid work or a minimum level of income.

16. Use of Nessie Training, Resources and Intellectual Property

All Nessie training materials, resources, videos, documents, designs, branding and other content remain the intellectual property of Nessie in Ed CIC or the relevant rights holder.

Membership provides a personal right to access materials associated with the member’s membership level.

Unless expressly authorised by Nessie, members must not:

  • copy or reproduce Nessie materials
  • share membership-only resources with non-members
  • upload or distribute materials elsewhere
  • modify or create derivative versions of Nessie resources
  • sell Nessie materials
  • use Nessie branding without permission
  • deliver Nessie-branded training without approval

Trainer and Lead Trainer members may use approved materials for authorised delivery only and in accordance with Nessie’s current training and branding requirements.

17. Community Standards

Nessie Community is intended to be a safe, respectful and supportive environment.

Members are expected to:

  • communicate respectfully
  • respect the experiences and views of others
  • protect other members’ privacy
  • avoid sharing identifiable information about children and young people unnecessarily
  • not present themselves as a substitute for qualified professional advice unless appropriately qualified and acting within their professional role
  • comply with the Nessie Community Code of Conduct

Discriminatory, abusive, threatening or otherwise inappropriate behaviour will not be accepted.

18. Safeguarding

Nessie takes safeguarding seriously.

Nessie Community is not an emergency or crisis service.

Where information shared within Nessie Community gives rise to a safeguarding concern, Nessie may take appropriate action in accordance with its safeguarding responsibilities, policies and applicable law.

Members should avoid sharing unnecessary identifying information about children or young people within Community areas or group sessions.

19. Suspension or Termination by Nessie

Nessie may suspend or terminate membership where there is:

  • persistent non-payment
  • serious or repeated breach of these Terms
  • serious or repeated breach of the Code of Conduct
  • misuse of Nessie materials or branding
  • inappropriate representation of Nessie
  • a safeguarding concern
  • conduct that may place members, children, young people or Nessie at risk

Where reasonably appropriate, Nessie will explain the reason for the action and any steps that may be required.

Any financial consequences of termination by Nessie will be handled fairly, taking account of the circumstances and applicable consumer law.

20. Changes to Membership

Nessie may occasionally need to make reasonable changes to membership content, benefits or delivery.

Where a significant change materially affects a paid membership, Nessie will provide members with reasonable notice wherever possible.

Any changes to membership prices will not ordinarily affect the price payable during an existing 12-month membership term unless agreed with the member.

21. Renewal

A paid membership runs for 12 months from the member’s original joining date.

Before renewal, members will be provided with information about their next membership period and the applicable membership fee.

Any automatic renewal arrangement will be made clear when the member joins and managed in accordance with applicable consumer law.

Members who do not wish to continue beyond their existing membership term must follow the cancellation/non-renewal process provided by Nessie.

22. Privacy and Data Protection

Nessie will process personal information in accordance with its Privacy Policy and applicable UK data protection legislation.

Members are responsible for ensuring the information associated with their account is accurate and up to date.

Members must not collect, store, share or otherwise use another Community member’s personal information without an appropriate lawful basis and permission where required.

23. Availability of Nessie Community

Nessie will make reasonable efforts to keep its online membership services available but cannot guarantee uninterrupted access.

Temporary interruptions may occur due to maintenance, technical problems or circumstances outside Nessie’s reasonable control.

24. Complaints

If a member has a concern or complaint about Nessie Community, they should contact Nessie using the contact details provided on the website.

Complaints will be handled in accordance with Nessie’s Complaints Policy.
